MARKETPLACE GENERAL TERMS
1. General Terms
1.1. In this document, unless the context requires otherwise, the following terms have the following meanings and are an integral part of it:
1.1.1. “Marketplace” – GOKUMARKET OÜ. GOKUMARKET in the framework of its activities provides a technical opportunity for sellers of goods and buyers to carry out transactions between themselves in the framework of the use of the service. GOKUMARKET is not a seller . GOKUMARKET acts as an escrow service in which it protects the interests of sellers and buyers.
1.1.2. “Buyer” - any physical/legal person who accepted the public offer on the terms of this agreement.
1.1.3. “Online store” - registered counterparties (shops) on the GOKUMARKET site.
1.1.4. “Goods” - object of agreement of the parties, the list of assortment names presented in the marketing program of GOKUMARKET
1.1.5. “Sales Rules” - Seller guarantees and undertakes to comply with legal requirements regarding the goods they sell in the jurisdiction in which they operate. Buyers, in turn, undertake not to purchase goods prohibited by the laws of the country to which the purchased goods are to be delivered. GOKUMARKET is not a seller and buyer of goods and is not responsible for the goods sold and purchased, as it is a worldwide marketplace, respectively, and some goods sold freely in some countries may be prohibited for sale and purchase in other countries.
1.1.6. “Promotional discount” - a discount that is given on a certain Good. The discount amount is specified on the Goods page.
1.1.7. “Discount on promotional code” - a discount, which is provided for a certain group of Goods when entering a special code when placing an order in the "Basket" of the Buyer.
1.1.8. “A promotional code” - a special code that gives a discount on a certain group of Goods and has an expiration date. To receive a discount on a promotional code, you need to enter the promotional code in a special field in the "Basket" of the Buyer when placing an order, some promotional codes can be applied automatically. Only one promotion code can be applied to one unit of goods.
1.1.9. “Permanent Buyer's Discount” - a discount provided by the online shop to the Buyer on certain conditions. Discount terms and conditions are provided in the "My Discount" section.
1.1.10. “GMC - GOKUMARKET CREDIT” - is a utility token used for the purchase of certain goods, cashback, referral & affiliate program, and used as a method of payment for fees on GokuMarket and can be traded for other digital currencies on the exchange.
2. This Public Offer (hereinafter - the Contract) is an official offer of GOKUMARKET to any individual who has the legal capacity and the necessary authority to enter into an intermediary agreement (escrow) with GOKUMARKET and the Online Store, as defined in this Offer and contains all the essential terms of the contract.
3. Consumer protection relations are regulated by the legislation of the country of location of the Seller or the Buyer. GOKUMARKET OÜ is the intermediary, the guarantor of the transaction between the Seller and the Buyer. Legal relations with GOKUMARKET parties are governed by the laws of the REPUBLIC OF ESTONIA.
4. In the marketplace GOKUMARKET credit (hereinafter referred to as TOKENS), as it is considered in the world practice, for rewarding Customers, active users, issuing cashback, and payment of transaction fee. In the GOKUMARKET marketplace, GMC tokens also function as a utility for tokens that function within the system (payment for goods, services, and cashback to customers). GOKUMARKET OÜ does not guarantee the growth of tokens, tokens are not an investment instrument, token holders are not paid from the profits of the marketplace.
5. GOKUMARKET strongly recommends that national legislation on the legal status of tokens and digital assets be studied. GOKUMARKET recommends not using GokuMarket Credit if digital assets are prohibited in your country, otherwise all risks and consequences of the use of tokens shall be at buyers’ own risk and discretion.
AGE RESTRICTION POLICY
Since listings on GokuMarket involve entering into a contract, we require all our members to be aged 18 years or older. This is to help protect both our community, as well as underage users.

6.1. What should I do if I think a person buying an item from me is underage?
You should report them to us, and include their username and any messages or email you've received from them.
6.2. When can I register on GokuMarket.com?
We allow people to register as members once they are 18 years old.
6.3. Age Restriction Policy Overview
To become a member of GOKUMARKET, individuals must be 18 years of age or older.
Violations of this policy may result in a range of actions, including:
1. Listing cancellation
2. Limits on account privileges
3. Account suspension
4. Forfeit of GOKUMARKET fees on cancelled listings
5. Loss of Seller status
If you believe a member to be underage, please let us know on: support@gokumarket.com. Make sure you give us their username and any other relevant information. If you have an email from the member, please be sure to include a copy.
6.4. Why does GOKUMARKET have this policy?
When GOKUMARKET members agree to buy or sell items, they are entering into contracts with each other. Individuals under the age of 18 are not allowed to enter such contracts by law, so GOKUMARKET does not allow them to register as members until they have attained 18 years of age.
7. All operations for the exchange, issue, and turnover of GOKUMARKET digital assets are performed by GOKUMARKET OÜ. All payments and operations are provided by GOKUMARKET OÜ (Registry Code 14876150).

1. To ensure all of our members have a great experience on GOKUMARKET, most purchases are covered by the GOKUMARKET refund policy.
2. GOKUMARKET Refund Policy means you're protected if the item you ordered didn't arrive, is faulty or damaged, or doesn't match the listing. You'll get your money back. For all the details of how the GOKUMARKET Refund Policy works, please see our full policy guidelines below.
About GOKUMARKET Refund Policy
3. Most GOKUMARKET sales go smoothly, but if there's a problem with a purchase, GOKUMARKET Refund Policy ensures that buyers receive the item they ordered or get their money back.
4. Buyers can use the GOKUMARKET Refund Policy when:
4.1. They don't receive an item, or
4.2. They receive an item that doesn't match the listing.
Most sellers work with buyers to quickly resolve issues, but if a solution isn't reached, GOKUMARKET can help.
4.3. What is covered:
Most transactions on GokuMarket.com are covered by the GOKUMARKET Refund Policy.
Purchases are covered by the GOKUMARKET Refund Policy when all of the following are true:
4.3.1. An item isn't received or it isn't as described in the listing.
4.3.2. A buyer reports that they didn't receive an item or requests a return within the GOKUMARKET Refund Policy timelines.
4.3.3. The buyer made the purchase on www.gokumarket.com via checkout or an GOKUMARKET invoice with one of the following payment methods:
i) Credit card or debit card
ii) GOKUMARKET gift cards
iii) Payment done using cryptocurrencies
4.3.4. The item was paid for in a single payment
4.3.5. Items collected in person are covered, provided all other requirements are met
4.4. Not covered:
4.4.1. Buyer remorse or any reason other than not receiving an item or receiving an item that isn’t as described in the listing (see the seller’s return policy for return options).
4.4.2. Items damaged during pickup.
4.4.3. Local pickup items that were not collected by, or on behalf of, the buyer.
4.4.4. Items not delivered, damaged during collection, or damaged during shipment when the buyer arranges pick-up or shipping of the item (for instance, the buyer arranges freight).
4.4.5. Duplicate claims through other resolution methods.
4.4.6. Items shipped to another address after original delivery.
4.4.7. Vehicles, Real Estate, Websites & Business for Sale, Classified Ads, services, Digital.
4.4.8. Content, Intangible Goods, and some Business Equipment categories.
Sellers are subject to this policy even if the transaction was completed on another GOKUMARKET site.
4.5 International coverage:
When a seller lists an item for sale with an international shipping option (such as worldwide shipping), it may result in the item being sold to a buyer on a GOKUMARKET site other than the seller's original listing site.
4.5.1. A buyer is covered by the applicable GOKUMARKET Refund Policy or
similar buyer protection policy of the GOKUMARKET site where checkout occurred.
4.5.2. When a buyer doesn't receive an item.
4.5.3. If a buyer doesn't receive an item, the buyer needs to submit a request to report that the item hasn't arrived. The seller should address the buyer's concern and provide tracking information, updates on the delivery of the item, or a refund.
4.5.4. If the buyer isn't happy with the seller's response or doesn't receive a response, the buyer can ask GOKUMARKET to step in and help.
4.5.5. If asked to step in and help, GOKUMARKET reviews the information provided by the buyer and seller for evidence of a successful on-time delivery to the buyer's address (as displayed on the 'Order details' page) or proof of collection by the buyer.
4.6. Information required to prove a successful on-time delivery is all of the following:
4.6.1. The tracking number provided by the shipping company uploaded to the site by the seller before the estimated delivery date.
4.6.2. A delivery status of "delivered" (or equivalent in the country to which the item was delivered)
I) The date of delivery;
II) The recipient's address, showing at least the city/county or zip code (or international equivalent) that matches the address displayed on the Order details page; and
III) Signature confirmation, if an item has a total cost of $500 or more.
4.7. If we determine that the item wasn't successfully delivered or collected, a refund of the full cost of the item and original shipping is sent to the original payment method or to the buyer's account.
4.8. The seller is required to reimburse GOKUMARKET for the amount of the refund.
GOKUMARKET has no responsibility to buyers, and in any case is not responsible to buyers for the quality of goods and their delivery. It shall be the sole responsibility of the Seller.
GOKUMARKET holds the Buyer's funds until receipt of the goods and/or delivery time of the goods, confirmation of receipt and other cases decided by GOKUMARKET.
5. Buyer Obligations:
5.1. Generally, the buyer is responsible for accepting the item when it arrives. If the buyer refuses delivery, their claim is not eligible for the GOKUMARKET Refund Policy.
5.2. Exceptions:
5.2.1. The buyer can provide, via written proof from the carrier, that they refused the package because it arrived empty or was damaged in shipping.
5.2.2. The buyer accepted and opened the package only to determine that it was an empty box.
5.2.3. The item arrived COD because it didn't have enough postage on it.
5.2.4. The buyer is responsible for paying any customs and duty fees for international shipping.
5.2.5. The seller overstated the value of the item, which caused customs fees to be higher.
6. When a buyer wants to return an item or the item doesn't match the listing:
6.1. If a buyer wants to return an item within a seller's return window or they received an item that doesn't match the listing, the buyer needs to submit a request to return the item. The seller should address the buyer's concern and offer a solution, such as accepting a return, or offering a replacement or refund. In some cases, we may automatically accept a return request on the seller's behalf.
6.2. If dissatisfied with the seller's solution, the buyer can ask GOKUMARKET to step in and help. If asked to step in and help, we may ask the buyer to return the item to the seller if:
i) We can't determine that the item received matches the listing description, even if the seller doesn't offer returns, or
ii) The seller's stated return window and policy applies to the item, or
iii) The seller has already offered to accept a return of the item.
6.3. When an item is returned to the seller:
If a buyer is returning an item within the seller's return window, the seller's return policy will indicate who pays for the return shipping label. The cost of return shipping for an item that is not as described is the seller's responsibility and, in cases where an GOKUMARKET-generated return shipping label is used for the return, the return shipping label cost will be added to the seller's invoice.
6.4. When a return postage label is made available to the buyer and/or the buyer chooses to purchase a separate label, the buyer won't be refunded by GOKUMARKET for the cost of the label.
6.5. Tracking is required to confirm the item has been returned to the seller. Signature confirmation is required for items returned with a total cost of $500 or more. If a seller chooses to offer the buyer an untracked return label and GOKUMARKET is asked to step in and help, the buyer will not be required to provide proof of delivery or signature confirmation.
7. Buyer obligations:
Buyers may be liable for any loss in value of the item if this loss in value is attributed to a handling which is not necessary for the purpose of checking the quality, characteristics and functioning of the item. Some sellers may deduct the amount of loss from the amount refunded to the buyer if the item is returned after being used or damaged by the buyer.
8. Seller obligations:
8.1. The seller is required to accept the return at the same location specified in the listing or at an address that does not result in a materially different return cost for the buyer
8.2. The seller is responsible for any customs and duty fees on the returned item
8.3. The seller is required to refund a buyer upon receipt of a returned item.
After confirming that the item was returned to the seller, a refund of the cost of the item (less any loss in the item's value, if the item is returned after it was used or damaged by the buyer) and original shipping is sent to the original payment method or the buyer's account. If the buyer arranged shipping or picked up the item, we may not refund the amount of original shipping or pickup cost. The seller is required to reimburse GOKUMARKET for the amount of the refund.
If GOKUMARKET is asked to step in and help, the seller will no longer be able to issue a partial refund to the buyer, even if the item is returned used or damaged by the buyer.
9. When an item isn't returned to the seller:
9.1. In some instances, we may not require that an item be returned to the seller. In these situations, we refund the buyer and may seek reimbursement from the seller, for example if:
9.1.1. The seller chooses not to accept a return request when they offered returns in the listing, or the return request was opened because the item was not as described
9.1.2. The seller did not provide a return shipping label or funds for the buyer to return the item
9.1.3. The item location was misrepresented
9.1.4. It's hazardous to ship back the item
9.1.5. The item no longer has a value (for instance, a ticket for a cancelled event)
9.2. Alternatively, with the buyer's consent, we may give a partial refund to cover differences between how the item was described in the listing and the actual item the buyer received. When given a partial refund, the buyer isn't asked to return the item to the seller. We may require the seller to reimburse GOKUMARKET for the partial refund.
10. Counterfeit items:
10.1. If a buyer reports that an item is counterfeit, and there are strong indicators that the item is counterfeit, we may not require the buyer to return the item to the seller. The buyer agrees to cooperate with us to ensure proper disposal of the item. In such instances, we refund the buyer for the full cost of the item and original shipping, and the seller reimburses us for the refund. The buyer may not sell the item on GOKUMARKET or elsewhere.
10.2. GOKUMARKET Refund Policy timelines:
10.2.1. Item not received:
A buyer can report that they didn't receive an item once the item's latest estimated
delivery date has passed, and for 30 days after the latest estimated delivery date.
10.2.2. For event tickets:
A buyer must report that they didn't receive the tickets no later than 7
days after the event date or 30 days from the latest estimated delivery date, whichever is later. For event tickets, a buyer must request a return no later than 7 days after the event date or 30 days from the actual (or latest estimated) delivery date, whichever is later.
10.2.3. The seller has 3 business days from the report to respond to the buyer with a solution (through either a replacement, a return, or a refund). If the seller does not offer a solution or the buyer is unsatisfied with the solution the buyer can ask GOKUMARKET to step in and help.
10.2.4. If the buyer doesn't ask us to step in and help within 21 business days of reporting that they didn't receive an item, the request closes automatically.
10.3. Item not as described:
A buyer must request a return no later than 30 days after the actual (or latest estimated) delivery date, or, if the seller's return window is longer, within the return window.
10.3.1. The seller has 3 business days from the request to respond to the buyer with a solution. If the seller does not respond with a solution, the buyer can ask GOKUMARKET to step in and Help.

10.3.2. The buyer has 5 business days from when the buyer starts the return to ship the item. If the seller hasn't received it within 10 days then they can ask us to step in and help. If the seller shipped a replacement or exchange and the buyer has not shipped the original item back within 20 business days of the buyer starting the return, we charge the buyer's GOKUMARKET account for the replacement or exchange.
10.3.3. For items where there's no tracking uploaded by the buyer, if the seller doesn't issue a refund within 2 business days of the item's return delivery date, the buyer can ask GOKUMARKET to step in and help for a period of 10 business days after the refund deadline has passed.
10.3.4. For items where the buyer has uploaded tracking, if the seller doesn't issue a refund within 2 business days of the item's delivery to the seller, we will automatically issue the buyer a full refund on the seller's behalf. The seller will be required to reimburse us for such refunds..
10.3.5. If the buyer doesn't ask GOKUMARKET to step in and help within 21 business days of starting a request for a return (or the timelines described if a refund, replacement or exchange isn't received), the request closes automatically.
11. Replacement and Exchange:
Replacement and exchanges can be requested by the buyer and/or seller.
11.1. Exchanges are based on the value of the original purchased item, with current and equal value. A buyer must request a return and select the replacement or exchange option no later than 30 days after the actual (or latest estimated) delivery date, or, if the seller's return window is longer, within the return window.
11.2. Timelines for replacement and exchanges:
When the buyer requests a replacement or an exchange the seller has 3 business days to respond to the buyer. If no response is received after 3 business days the buyer can ask GOKUMARKET to step in and help.
If a replacement or exchange is agreed upon, the buyer has 5 business days to ship the item back to the seller with return tracking. If the buyer doesn’t ship the item within 5 business days, the replacement or exchange will be closed.
11.3. If the buyer doesn’t ship the return item back to the seller, and the seller shipped the replacement or exchange with a confirmed delivery scan, after 20 business days the seller will be paid the value of the additional item. The buyer will be charged for this additional item via the buyer’s GOKUMARKET account.
12. Latest estimated delivery date:
12.1. When we have no information about the actual delivery date, we use the latest estimated delivery date. When we have no estimated delivery information, we consider the latest estimated delivery date to be 7 days from payment date for transactions between a buyer and seller in the same country, and 30 days from the payment date for buyers and sellers in different countries.
13. Extended timelines for GOKUMARKET Refund Policy coverage:
In some limited situations, we may extend the period of time in which a buyer is eligible for the GOKUMARKET Refund Policy. This extra time allows us to take into consideration the buyer's location, the shipping service used, a seller's extended return window, national holidays, or delays due to circumstances such as natural disaster, national emergency, labor strike, or governmental act, or other circumstances such as fraud. In most instances, when we extend timelines for GOKUMARKET Refund Policy coverage, in cases where the seller is responsible for requests opened during such an extended timeline, we notify sellers with an announcement on www.gokumarket.com.
14. Appeals:
14.1. Buyers and sellers have an opportunity within 30 days from when we make a decision about a transaction issue to appeal the decision by providing appropriate documentation. GOKUMARKET reserves the right to seek reimbursement from the seller if a buyer successfully appeals.
15. Refunds to buyers:
We refund buyers to their original payment method or their GOKUMARKET account. In the unlikely event that we're unable to send refunds to the original payment method or the buyer's GOKUMARKET account, we may provide refunds by coupon or vouchers redeemable for future purchases on GOKUMARKET.
16. Seller funds, reimbursements, and fees:
16.1. Seller funds:
After a buyer reports that they didn't receive an item or requests a return, or asks GOKUMARKET to step in and help, a seller's funds may be set aside by GOKUMARKET.
16.2. Reimbursements:
16.2.1. If a transaction dispute arises between a buyer and seller and GOKUMARKET resolves such dispute in favor of the buyer, the seller authorizes GOKUMARKET to reverse the funds to reimburse the buyer, and if such funds are unavailable or insufficient, the seller agrees to reimburse GOKUMARKET for any amount GOKUMARKET refunds to the buyer.
If reimbursement is unsuccessful, the seller agrees to allow GOKUMARKET to charge their reimbursement or automatic payment method on file for amounts refunded to the buyer.
16.2.2. GOKUMARKET may place the amount refunded to the buyer on their invoice subject to their automatic payment method. The seller will remain obligated to pay GOKUMARKET for all unpaid amounts and GOKUMARKET reserves the right to seek reimbursement through other means.
16.3. Seller fees:
If a seller issues a buyer a full refund before GOKUMARKET is asked to step in and help, we credit the seller's final value fee. Insertion fees and other GOKUMARKET fees aren't refunded.
17. Using other programs to address a concern:
Buyers can't use more than one resolution method to get a refund. After selecting a resolution process (GOKUMARKET Refund Policy or requesting a chargeback from their payment provider) a buyer is required to use only that process to resolve the transaction issue.
If a buyer requests a chargeback from their payment provider, any requests opened through GOKUMARKET for the same transaction are immediately closed.
18. Fraudulent claims and abusive buyer behavior:
Buyers who engage in activity as Abusive behavior may be subject to a range of actions, including the loss of GOKUMARKET Refund Policy coverage, issuing warnings to buyers, blocking buyers from requesting returns or refunds on GOKUMARKET, blocking buyers from opening claims, and account suspension.
18.1. Activity that is not allowed includes, but is not limited to:
I) A buyer opening duplicate requests using other buyer protection programs
II) A buyer colluding with a seller to wrongly declare an item's value for customs
III) A buyer filing a chargeback after receiving a refund
IV) A buyer claiming an item was not received when there is proof of delivery to the buyer's address on the Order details page
V) A buyer falsely claiming an item was not as described
VI) A buyer returning an item other than the original item received
VII) A buyer using or damaging an item and then returning it
18.2. In addition, we reserve the right to indefinitely suspend the buyer's coverage under the GOKUMARKET Refund Policy.
19. Other terms:
19.1. Buyers and sellers permit us to make final decisions about all cases, including appeals. We may provide buyers and sellers with access to each other's names, usernames, contact information, and other information relating to a request.
19.2. When a buyer and seller don't speak the same language, we may assist with communication until the issue is resolved.
19.3. The GOKUMARKET Refund Policy is not a product warranty:
In some situations, we may open and decide on a request on behalf of the buyer. This includes situations in which a seller is suspended for fraudulent activity:
I) For items shipped through the Global Shipping Program, the program's terms and conditions for buyers describe how members are protected by the GOKUMARKET Refund Policy.
II) We reserve the right to fix any processing errors we discover by debiting or crediting the payment method used for the incorrect refund or reimbursement.
20. Cancellation Policy
20.1. Before cancelling an order, we recommend you contact your seller and try to reach a mutual agreement. If your order has not been paid for yet, you can cancel it online by clicking the “Cancel Order” button in the “All Orders” section of the personal account on the site.
20.2. If you have paid for your order, please wait and give our system some time to verify your payment before cancelling the order. It will take 2-3 business days to verify the payment via Credit Card, and if paid via cryptocurrency it is verified instantly. Then your order status will be updated as paid and you can submit a dispute online to apply for a refund. Our professional dispute team will handle your case accordingly.
SELLER POLICY
Rules on Resolving Image Piracy Complaints
GokuMarket.com has been committed to acting in good faith and actively maintaining a good market order on the platform. In order to curb image piracy and enhance user experience, these Rules are hereby formulated in accordance with the Rules of GokuMarket.com.
1. Definition of Image Piracy:
Image piracy means any act of any user of using any image without the consent from the image owner and publishing such image on GokuMarket.com.
The principle for handling any complaint is that the complaining party should be the information owner and no complaint from a third party will be accepted.
2. Rules of Penalty on Image Piracy:
If any complaint is justified: in respect of the party who posted the image, the following measures are applied:
i) the first violation is punished by a warning,
ii) the second violation entails a ban of the party.
3. Supplementary Provisions:
i) GokuMarket shall have the right to promptly amend these Rules based on the amendments to laws and regulations, changes in business environment or other reasons and to announce the same. The amended Rules will come into force as of the date specified in the announcement.
ii) These Rules are an integral part of the Rules of GokuMarket.com. In case of any inconsistency between these Rules and the Rules of GokuMarket.com, these Rules shall prevail. For any matters not covered herein, the Rules of GokuMarket.com shall apply.
iii) If there is any inconsistency, discrepancy or conflict between any other language versions of these Rules, the English version shall prevail.
4. Rules for Handling Unauthorized Use of Third Party Information
4.1. GokuMarket.com is completely dedicated and committed to act in good faith and actively maintain a good market order of the platform. In order to curb unauthorized use of others’ information and enhance user experience, these Rules are hereby formulated in accordance with the Rules for Transactions on GokuMarket.com.
Article 1
Definition of Unauthorized Use of A Third Party’s Information
4.2. Users of GokuMarket (“GokuMarket.com”) shall not use the services provided on the website to engage in any acts using a third party’s information without the authorization of information owner, which include but are not limited to:
4.2.1. Unauthorized use of a third party’s name
4.2.2. Unauthorized use of a third party’s contact information
4.2.3. Unauthorized use of a third party’s certificate
4.2.4. Unauthorized publishing of a third party’s office photo
4.2.5. Others
The principle for handling complaints is that the complainant should be the information owner and no complaint from a third party will be accepted.
Article 2
Rules for punishment of Unauthorized Use of a third party’s information.
4.3. Response to Complaint
The first complaint is verified and the complainee deletes the improper information during the response period.
4.4. Punishment:
Serious warning and deleting the improper information that includes a third party
Information.
4.5. Action: Second attempt of such unauthorized use.
4.6. Response to complaint: The second or subsequent complaint is verified.
4.7. Punishment: TERMINATION OF AGREEMENT OF COMPLAINEE AND COMPLETE BAN.
4.8. It should be duly noted by the complainant that the response period is five working days. If there is no response within such period, it shall be deemed as the complaint has been verified. There is a protection period of 5 calendar days for the complaints about unauthorized use of a third party’s information, i.e., if several complaints are verified in 7 calendar days, the points will be deducted only once. Such protection period is subject to the date on which the complaint is settled.
4.9. Where any company uses a third party’s information without authorization, causing material adverse effects, and refuses to cooperate, GOKUMARKET reserves the right to delete the information from the complainee’s account.
Article 3. Miscellaneous:
4.10. GOKUMARKET shall have the right to promptly amend these Rules based on the amendments to laws and regulations, changes in business environment or other reasons and to announce the same. The amended version of these Rules will come into force as of the date specified in the announcement.
5. Rules for Filling of Product Information
5.1. General Rules
These Rules are formulated for the purposes of regulating the filling of product information by sellers on GokuMarket.com maintaining the market order on the platform, and enhancing user experience.
5.2. Product Name, Attributes & Keywords:
a) Product names must be consistent with the other product-related information, including product photos, product descriptions, etc. They must be as accurate, complete and concise as possible. Any Users may use product names, generic names, etc.
b) Product attributes must be consistent with the actual condition of the product, and accurately showing the ingredients, materials, sizes, brands, models, places of origin, etc.
c) Users may set 1-3 keywords that match the products to facilitate buyers’ searches.
5.3. Product Description:
Any brief and detailed descriptions of a product shall be based on the actual condition of the product. Such descriptions can introduce functions, characteristics, specific instructions for use, packaging information and accessories of the product in detail, and display pictures of products, product details and packaging as well as the design sketches, etc.
5.4. Product Groups:
All Users must categorize products according to their types, attributes, materials, functions, etc., and set up product groups to facilitate buyers to browse, select and pinpoint the products they want to purchase. Without the authorization of the trademark owner, any third party trademark shall not be used as the name of the product group.
5.5. Product Images:
Product images must be consistent with the text information and must accurately reflect the actual situation/condition of the product. Unless otherwise specified, images must be clear, complete, without smear or cover. More detailed instructions are as below:
a) There must not be any trace of smearing on the product or product packaging.
b) The product or product packaging cannot be completely or partially covered by items unrelated to the product, unless otherwise specified in these rules.
c) Image specifications: the size of the image must not exceed 5MB; the image ratio must be between 1:1 and 1:1.3 and the resolution must be greater than 800px * 800px. Images that do not meet the specifications will not be uploaded to the product release interface.
5.6. Special Products:
Product images must be consistent with the text information and must accurately reflect the actual condition of the product. Unless otherwise specified, images must be clear, complete, without smear or cover. Detailed instructions are as below:
a) There must not be any trace of smearing on the product or product packaging.
b) The product or product packaging cannot be completely or partially covered by items unrelated to the product, unless otherwise specified in these rules.
5.7. Payment and Shipping:
Payment and shipping options must be consistent with the actual service capability of suppliers. The suppliers must accurately fill in the minimum order quantity, port, packaging, shipment time, payment method, unit of measurement, total supply quantity, unit price, etc.
6. Action against Non-compliance Relating to Inappropriate Product Postings:
GokuMarket.com is committed towards acting in good faith and actively maintaining a good market order of the platform. In order to stop inappropriate product postings and enhance user experience, these Rules are hereby formulated:
Article 1. Definition (Non Compliance)
6.1. Non-compliance in connection with inappropriate product postings (hereinafter referred to as “Inappropriate Product Postings”) shall refer to non-compliance by seller in posting product information on GokuMarket.com, including but not limited to inappropriate product title description, mis categorized product, duplicate product postings, false product pricing and false minimum order quantity (MOQ) of product, etc.
Article 2. Types of Non-compliance
6.2. Inappropriate product title/description:
Inappropriate product title description includes without limitation:
6.2.1. no clear product name in title description;
6.2.2. containing contact information in title description;
6.2.3. excessive product names in title description;
6.2.4. excessive product descriptions in title (including without limitation to excessive product names, brands, model numbers and descriptive words);
6.2.5. inconsistency between product name in title, description and product pictures;
6.2.6. inconsistency of seller’ intention stated in product title description and that stated in detailed product description, etc.
6.3. Miss-categorized product:
Miss-categorized product refers to product postings that are placed in inappropriate categories.
In selecting product category, seller shall select a category that closest matches and is most appropriate for your product, and shall not select the category “others” as long as there is any other suitable category.
The category recommended by the system shall be for reference only. Sellers shall carefully select the related and suitable category according to the attributes that describe your product.
For prohibited and controlled categories, seller shall select the designated categories in product postings, failing which, such seller shall be deemed to circumvent rules governing the prohibited and restricted categories and GokuMarket.com shall have the right to impose enforcement actions in accordance with Enforcement Actions for Displaying Prohibited and Controlled Items.
6.4. Goods, Works, and Services Prohibited For Sale Via The System:
6.4.1. Weapons, ammunition and defense products, replicas of firearms or cold steel weapons.
6.4.2. Drugs, drug-like substances and plants, as well as their ingredients, or any substances for their production, as well as descriptions of methods for producing such substances.
6.4.3. Medical drugs and medications dispensed on prescription only, as well as raw materials or instructions for their production.
6.4.4. State awards or distinguishing badges.
6.4.5. Identification documents and government issued documents (including falsified documents), and everything connected with creating or obtaining false identification documents or counterfeit government issued documents.
6.4.6. Government agencies’ uniforms.
6.4.7. Specialty items related to the police and law enforcement agencies.
6.4.8. Electronic equipment prohibited for use in this country or region.
6.4.9. Devices used for hacking and tampering with locks.
6.4.10. Information containing personal data or data suitable for undertaking illegal activities (spam emails, etc.).
6.4.11. GWS or information containing state, banking, or trade secrets.
6.4.12. GWS whose sale violates any third parties’ copyright and/or related rights, trademark rights, or patents.
6.4.13. Information that violates a person’s privacy, infringing upon the honor, dignity and business reputation of individuals and legal entities.
6.4.14. Information transmitted exclusively virtually and not recorded on any material carrier (ideas, methods, principles, etc.).
6.4.15. Archeological heritage items.
6.4.16. Items or services that violate the norms of public morality (including, but not limited to, child pornography, Nazi memorabilia items, escort services, and prostitution).
6.4.17. Any items with initially available but removed serial numbers.
6.4.18. Malicious software.
6.4.19. Goods or services directly or indirectly compelling illegal actions (promoting social, racial, religious, or ethnic strife; discrimination, violence, hatred, revenge, harassment; containing propaganda of terror or physical harm).
6.4.20. Perishable goods.
6.4.21. Fake or counterfeit goods.
6.4.22. Items and equipment intended for use (including illegal transfer) of copyright protected items without the permission of the authors (including, but not limited to, components designed to remove copyright protection or regional restrictions, or software elements of electronic devices).
6.4.23. Dangerous goods (including, but not limited to, those that contain explosive, toxic, poisonous, and/or radioactive materials).
6.4.24. Information about the production of explosive, pyrotechnic, incendiary, and other similar substances and devices.
6.4.25. Human organs and human remains.
6.4.26. Goods or services that have no value in use.
6.4.27. Services of auctions or trading systems that allow carrying out activities excluding transfer of GWS that have value in use.
6.4.28. Financial or payment instruments whose accounting systems do not ensure proper identification of the owner for the purpose of combating illegal trade, financial fraud, and money laundering of funds obtained by illegal means.
6.4.29. Asset management and investment services provided by unlicensed businesses, as well as any intermediary activity that facilitates the transfer of funds between the parties entering into a transaction forbidden herein.
6.4.30. Items of artistic and historical value that constitute a country’s cultural values.
6.4.31. Services of organizers and operators of lotteries, betting, casinos and any other types of gambling.
6.4.32. Services of advertising (promoting) goods, works and services specified in items 1-31 of this list.
6.5. Duplicate product postings:
Duplicate product postings refers to the product information posted by the seller being identical or similar, or major product attributes or descriptions (including but not limited to brand, specification, model, material, picture, etc.) being identical or similar.
6.6. False product pricing and false MOQ (Minimum Order Quantity) of product:
Such non-compliance includes without limitation:
6.6.1. the product price range posted is significantly different from the market price of similar product in the same industry;
6.6.2. the product price posted is low but the shipping cost is significantly higher than average;
6.6.3. the shipping cost actually charged is higher than that posted by seller;
6.6.4. providing false MOQ of product, etc.
Article 3. Enforcement Actions:
Where seller has committed, or GOKUMARKET OÜ reasonably believes that seller has committed, the aforementioned non-compliance relating to Inappropriate Product postings, GOKUMARKET OÜ will take the enforcement actions as follows:

I) The product that is involved in Inappropriate Product Postings (except for duplicate product postings) will be blocked in search results. GOKUMARKET OÜ reserves the rights including but not limited to take down or delete such product postings.
For products that are involved in duplicate product postings, such product information will be displayed only once in search results, namely, the product with the highest buyer preference and the best record effect will be displayed when buyer searches for a similar product with a particular keyword. Other duplicate product information will not be displayed in search results.

II) If any non-compliance relating to Inappropriate Product Postings is found by the platform, the ranking of the entire store shall be lowered in search results for seven (7) days. In addition, for non-compliance in product title description, false product pricing and false MOQ of product, 0 penalty point will be deducted for the first three violations in a given year and two (2) penalty points will be deducted for each of the fourth and the subsequent violations (including violations detected and confirmed by the system).

GOKUMARKET OÜ reserves the right to promptly amend these Rules in accordance with any changes to laws and regulations, changes in business environment and other factors and to announce the same. The amended Rules will come into force as of the date specified in the announcement.
